Applicability
This procedure applies to all vehicles owned and/or operated by Lane Community College.
Please see Oregon Revised Statutes 801 through 820 for all Department of Motor Vehicles (DMV) Regulations (ORS 750 through 835).
Definitions
The college owns and/or operates the following types of vehicles:
- Motor Vehicles have at least four wheels, a gross vehicle weight in compliance with its size and number of wheels, meet all safety standards such as having windshield wipers, lighting, brakes, rear-view-mirrors, VINs, seat belts, etc., are self-propelled and capable of exceeding 25 MPH. This category includes trucks of all kinds. See ORS 801.360.
- Low Speed Vehicles have four wheels, a gross vehicle weight of less than 3,000 pounds, meet all safety standards such as windshield wipers, lighting, brakes, rear-view-mirrors, VINs, seat belts, etc., and are capable of exceeding 20 MPH but not exceeding 25 MPH. These vehicles have a driver seat, a passenger seat, and usually a covered space in the rear compartment. They may be natural gas, gasoline or battery/electric powered. At Lane, they are driven by both staff and work-study students. They are used for delivery of packages throughout the main campus and on rare occasions may be used for shuttling a passenger from one location to another. The DMV permits registered and titled Low Speed Vehicles to be driven on public roads where speed limits do not exceed 35 MPH. These vehicles are included in the DMV requirements for motor vehicles. See DMV Registration and Title Manual, Policy #57-03.
- Exempt Vehicles are service vehicles usually utilized by staff or work study students for transferring materials or workers to various locations on the main campus; they are golf cart type vehicles, usually battery powered, almost all uncovered and un-enclosed, and used primarily for service functions within the main campus. They are not regulated by the DMV. See ORS 801.295.
- Instructional Vehicles are motor vehicles and low-speed vehicles utilized only for instruction in the Mechanical Technologies Department. This is not a DMV category.
- Salvage and Dismantled Vehicles may be owned by the college but are not permitted to be operated in any manner (the engine may be started but vehicle shall not be driven or moved under its own power). If a vehicle registered as "Salvage" is intended to be moved under its own power, a "Trip Permit" shall be obtained from the DMV by the responsible department before such vehicle is moved. Vehicles registered as "Dismantled" may never be moved under their own power.
Vehicles which are registered as "Dismantled" or "Salvaged" shall be carried on the college books as "equipment" (not as motor vehicles) and shall not require coverage of liability insurance except when driven. See references to "Trip Permit" herein.
All other instructional motor vehicles; i.e., those which maintain unrestricted titles and current registrations, shall carry not less than the minimum legal amount of liability insurance and other types of insurance as may be deemed prudent by the college risk manager. They shall be added to the college's Automobile Liability Schedule. Any vehicle which is registered as "Salvage" which is being moved under its own power within the authorization of a "Trip Permit" shall be covered with liability insurance before being moved.
Legal and Operating Requirements
All motor vehicles owned and/or operated by Lane Community College shall be operated in compliance with all applicable laws, rules and regulations and shall be complemented with all appropriate safety equipment for the type of use. Specifically, the requirements of Oregon Revised Statutes 801 through 820 shall apply to all Lane Vehicles.
Except for Exempt Vehicles, each such vehicle shall be registered with the DMV in the category appropriate to its use.
Each department operating such vehicles shall be responsible for determining the DMV registration category and shall also be responsible for ensuring that the vehicle is operating in compliance with its particular registration category.
Each such vehicle shall be maintained in safe working order.
Except for Exempt, Salvaged or Dismantled Vehicles, each such vehicle shall be registered with "government" license plates (see Lane's Vehicle Identification procedure and the Oregon Department of Transportation's Government Vehicle Registration Information page).
Except for Exempt Vehicles, each such vehicle operated on public roads; that is, roads owned and maintained by any political subdivision other than Lane Community College District, shall have current DMV titles and license plates and shall be insured as a motor vehicle in compliance with college policy (see Insurance: Vehicles). This includes Low Speed Vehicles. Proof of registration and insurance shall be carried in the glove compartment or similar compartment of each such vehicle. Each such vehicle shall be added to and included within the college's Automobile Liability Insurance Schedule.
Instructional vehicles, used for instructional purposes only, may be registered as motor vehicles and as such, shall comply with all motor vehicle requirements. These vehicles may also be registered as "Salvage" or "Dismantled" vehicles, whichever suits the use of the vehicle.
Vehicle Coordination
Purchase, donation, registration, use and disposal of all vehicles shall be coordinated through the director of Facilities Management. That individual shall maintain a fireproof cabinet in which all titles of motor vehicles shall be stored and shall coordinate the handling of all DMV applications and vehicle documentation for title changes, registration and motor vehicle disposal. That individual shall maintain a current listing of all DMV-subject vehicles owned by the college.
Licensing and Operating Costs
The department to which each college vehicle is assigned shall be responsible for payment of all fees and other costs associated with the registration and maintenance of its vehicles.
Operating Areas
Normally licensed and insured motor vehicles may be driven on all public roads and rights-of-ways.
Low Speed Vehicles may be driven on Eldon Shafer Road and Gonyea Road but NOT on 30th Avenue or any access ramps thereto.
Exempt Vehicles may not be driven on any public roads; Eldon Shafer Road and Gonyea Boulevard are public roads.
Insurance
When a department purchases a vehicle, the following information needs to be submitted to the Office of Emergency and Risk Management as soon as possible for insurance purposes:
- Year;
- Make;
- Model;
- Vehicle Identification Number;
- Value; and
- E-Plate Number
An insurance identification card will then be sent to the department. This identification card is to be kept in the vehicles at all times. New identification cards are issued at the beginning of each fiscal year. All new vehicles must be licensed with an E-plate and identified with the LCC logo. Any vehicle that is registered, titled in accordance with DMV regulations and driven on a public road must carry automobile liability coverage, i.e., be listed on the college's Automobile Liability Insurance Schedule. Exempt vehicles are automatically covered on the college insurance policy for liability under the General Liability coverage section of the policy and shall not be placed on the liability schedule unless driven on public roads. If any Exempt vehicle is intended to be driven on a public road, it must be placed on the college's liability schedule before being driven on a public road. If and when such a vehicle is listed on the liability schedule, that vehicle may be driven on Eldon Shafer Road and Gonyea Road only.
