Purpose

This procedure describes the specific responsibilities of the Department of Public Safety (Public Safety), when responding to verified reports of Animal Neglect. Here animal neglect means: A person intentionally, knowingly, recklessly or with criminal negligence fails to provide minimum care for an animal in such person’s custody or control. (See also ORS 167.325).

Narrative

A person shall be cited by Public Safety for animal neglect when reasonable provisions for animal care, particularly, but not limited to, within a motor vehicle, are not met. Common examples of citable offenses include:

  1. Keeping an animal in a vehicle parked on college property without water;
  2. Keeping an animal in a vehicle even with access to fresh air and water and conditions that endanger the health or well-being of an animal due to heat, cold, lack of adequate ventilation, or other circumstances that could reasonably be expected to cause suffering, disability, or death to the animal are present.
  3. Keeping an animal in a motor vehicle where any combination of conditions a and b are present.

In any of the above cases, attempts will be made to contact the registered owner of the vehicle to immediately correct the conditions and the Public Safety officer will issue a citation and sanctions as described below.

Note: At Public Safety’s discretion local law enforcement or animal control agencies will be contacted to address the situation and under ORS the agency will take enforcement action per their own policies and procedures.
