Narrative

All complainants shall receive a confirmation email after submittal and all complaints received shall be investigated, regardless of the way in which they are submitted. Any investigative interviews with represented employees shall include the offer of union representation. Upon completion of the investigation, a fact-finding report shall be produced by HR and sent to the appropriate Vice President who will render a decision. Decisions affecting an employee’s continued employment may be appealed to the President.

Retaliation

Retaliation against the complainant or any person who participates in the complaint process is expressly forbidden. The College will safeguard the complainant's rights against retaliation by taking prompt and appropriate corrective action when necessary. An individual who is subjected to retaliation (e.g. threats, intimidation, reprisals, or adverse employment or educational actions) for having made a report in good faith under this procedure, for having assisted someone with a report, or for having participated in any manner in an investigation or resolution of a report, is encouraged to make a report of retaliation under this procedure using this procedure.

Given the sensitive nature of making such a complaint, the College will ensure that additional precautions are taken to protect the safety of the complainant. If requested by the employee, this can include an offer to meet and consult, with the goal of reaching mutual agreement of the College, their designated representative, and the complainant to address safety concerns.

Confidentiality

All complaints that are submitted pursuant to this procedure will be maintained with confidentiality to the degree possible and as limited by applicable laws and collective bargaining agreements.

Anonymous Complaints

All complaints are reviewed and handled with care and concern for our employees. If a concern is reported anonymously, it will be reviewed to the extent possible. However, anonymous complaints may affect the College’s ability to investigate and respond effectively.

Timing

The amount of time required to completely investigate a complaint under this procedure will vary based upon the facts and circumstances of the complaint, HR will complete the investigation as expeditiously as possible.
